Terms of Service

You can use HeyArab only if all of the following are true:

• You are at least 18 years old.
• You are legally able to enter into a binding contract under the laws of where you live.
• You are not required to register as a sex offender in any jurisdiction.
• You haven't been previously banned from HeyArab.
• Your use of the service is not prohibited by the laws of where you live.

If you create an account on behalf of someone else, you represent that you have the legal authority to do so. We don’t allow accounts opened by parents, friends, or anyone else on someone else’s behalf.

• You must provide accurate information when you sign up and keep it accurate.
• You may have only one HeyArab account at a time.
• You are responsible for keeping your phone, email, and any other authentication factor secure.
• You must notify us right away if you suspect someone else has accessed your account.

You keep all rights to the photos, voice intros, prompts, messages, and other content you put on HeyArab (your “Content”). You are responsible for it, and you confirm that you have the right to share it and that doing so doesn’t violate anyone else’s rights.

By uploading Content, you grant HeyArab a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, display, reproduce, modify (only to the extent necessary to format the content for the service, for example generating thumbnails or transcoding voice notes), and distribute that Content for the purpose of operating, providing, and improving HeyArab. This license ends when you delete the Content or your account, except where the Content is part of a message already delivered to another person, where it has been retained as part of a moderation record, or where it has to be retained to comply with law.

HeyArab Club is our optional subscription tier. Joining unlocks features described in the app at the time you subscribe.

How billing works

• Subscriptions auto-renew at the end of each billing period (weekly, monthly, three-month, or six-month) unless you cancel at least 24 hours before the renewal date.
• Payment is charged by Apple (for iOS) or Google (for Android), using the payment method on file with your App Store or Google Play account. We never see your card number.
• Prices are shown in your local currency at the time you subscribe; tax may be added depending on where you live.
• If you start a free trial and don’t cancel before it ends, the subscription becomes a paid one automatically.

Cancellation and refunds

• Cancel anytime from your device’s subscription settings: Apple ID → Subscriptions on iOS, or Google Play → Payments & subscriptions on Android. Cancelling stops the next renewal; the current period stays active until it ends.
• Refund requests go through Apple or Google directly. We can’t issue refunds for store-purchased subscriptions ourselves.
• If you live in the EU, the UK, or another jurisdiction with statutory withdrawal rights, your local rules may give you a cooling-off period; those rules override anything in this section.

HeyArab is for meeting other adults sincerely. The following are not allowed:

• Harassment, threats, hate speech, or content that targets anyone based on race, ethnicity, national origin, religion, gender, sexual orientation, age, disability, or any other protected characteristic.
• Sexually explicit photos or messages, including nudity. We allow tasteful images; we don’t allow pornography.
• Impersonation, fake profiles, or misrepresenting who you are (including your relationship status, age, or photos that aren’t of you).
• Solicitation, sex work, or commercial offers of any kind.
• Content involving anyone under 18, including photos of yourself when you were a minor.
• Spam, off-platform contact requests for commercial purposes, or attempts to drive users to other apps for commercial reasons.
• Scraping, crawling, reverse-engineering, decompiling, or accessing the service through automated means (including bots).
• Using the service to circumvent technical protections, for example taking screenshots of someone else's content and sharing them off-platform without consent.
• Anything illegal where you live, where the other person lives, or where HeyArab operates.

If you see something that violates these rules, report it from the profile or message. We review reports through a moderation queue and act on them quickly.

We may, at our sole discretion, suspend, restrict, or terminate any account that we believe in good faith violates these Terms or harms other members. Depending on the severity, action can include hiding profiles from discovery, time-limited suspensions (typically 30 days), or permanent bans. We log every action a moderator takes for accountability.

HeyArab does not run background checks on its members. Be careful when meeting anyone for the first time: meet in a public place, tell a friend where you’ll be, and trust your instincts. We are not responsible for the conduct of our members on or off the service.

Photo verification is voluntary. If you opt in, we ask you to record a short selfie video and check it against your profile photos using AWS Rekognition. A verified profile gets a small badge that other members can see. We don't require verification, and not verifying doesn't reduce the matches we show you. You can ask us to remove your verified status at any time by emailing support@heyarab.app.

Voice intros are short audio clips you record while answering one of our prompts. By recording one, you confirm that the voice is yours and that you consent to its display on your profile. You can delete a voice intro at any time from your profile.

The HeyArab name, logo, wordmark, and any other HeyArab marks are trademarks of HeyArab. The software, design, and underlying systems are owned by HeyArab or our licensors. These Terms don’t grant you any rights to those marks or to our intellectual property beyond using the service as intended.

You can terminate this agreement at any time by deleting your account from Settings. We can terminate or suspend your account if we reasonably believe you’ve broken these Terms, if your account has been inactive for more than 12 months, or if we stop offering the service. We will tell you in advance unless we believe doing so would harm other members.

Sections that by their nature should survive termination will survive. That includes the Content license you granted us, disclaimers, limitation of liability, indemnification, and dispute resolution.

HeyArab is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or that the service will be uninterrupted or error-free. We do not guarantee that you will find a match, that any particular member is who they say they are, or that any interaction on or off the service will be safe or successful.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you. In those places, we exclude warranties to the maximum extent the law allows.

To the maximum extent permitted by law, neither HeyArab nor our affiliates, directors, employees, or licensors will be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of the service.

In any event, our total liability for all claims related to the service is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) one hundred U.S. dollars (USD 100).

These limits don’t apply to liability that can’t be excluded under your local law (for example, certain consumer protections in the EU, the UK, and parts of Australia).

You agree to defend and indemnify HeyArab against claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the service in violation of these Terms, your Content, or your interaction with another member. We'll let you know promptly about any claim and let you control the defense, provided you do so reasonably and in good faith.

If you downloaded HeyArab from the Apple App Store, the following additional terms apply between you and HeyArab. To the extent these terms conflict with anything else in this document, these terms control for the iOS app:

• These Terms are between you and HeyArab. Apple is not a party.
• Your license to use HeyArab is non-transferable and limited to use on Apple-branded devices that you own or control, in accordance with the Usage Rules in the Apple Media Services Terms.
• Apple is not responsible for the service or its content, and Apple has no obligation to provide maintenance or support services.
• In the event of any failure to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation regarding HeyArab.
• Apple is not responsible for addressing claims by you or any third party relating to HeyArab or your possession or use of HeyArab, including product-liability claims, claims that HeyArab fails to conform to legal requirements, and claims under consumer-protection or similar legislation.
• In the event of a third-party claim that HeyArab or your possession or use of it infringes that party’s intellectual property rights, HeyArab, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of the claim.
• You confirm you are not located in a country subject to a U.S. government embargo or designated as a "terrorist supporting" country, and you are not on any U.S. government list of prohibited or restricted parties.
• Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

If you downloaded HeyArab from Google Play, you also agree to comply with the Google Play Terms of Service. Google is not a party to these Terms and is not responsible for HeyArab. The standard Google Play refund window is 48 hours from purchase; after that, refund requests follow the same path as Apple, through the store and not us.

Informal resolution first

If you have a dispute with us, please email support@heyarab.app with a short description of the issue and what you’d like us to do. We commit to responding within 30 days and to working in good faith to resolve the issue informally.

Binding arbitration

If we can’t resolve it informally, you and HeyArab agree to resolve any dispute through binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules (or, for claims under USD 25,000, its Optional Procedures for Consumer Disputes). Arbitration will take place in Wilmington, Delaware, or by videoconference if you prefer. The arbitrator’s decision is final and enforceable in any court of competent jurisdiction.

Class-action waiver

You and HeyArab agree to bring claims only on an individual basis. Neither of us will participate in a class action, class arbitration, or representative proceeding. If a court finds the class-action waiver unenforceable, the entire arbitration agreement will be void, but the rest of these Terms still apply.

Opt-out

You can opt out of the arbitration agreement and the class-action waiver by emailing support@heyarab.app within 30 days of first agreeing to these Terms. Include your name, your phone number, and the words “Arbitration Opt-Out”.

Exceptions

Either of us can bring a claim in small-claims court if it qualifies, and either of us can ask a court for an injunction to protect intellectual property or to stop unauthorized access to the service. Nothing in this section limits your statutory rights to take a complaint to a regulator or to consumer-protection authorities in your country.

Governing law

These Terms are governed by the laws of the State of Delaware, U.S.A., without regard to its conflict-of-laws rules. If you live in the EU, the UK, or another jurisdiction whose mandatory consumer-protection laws apply, those laws prevail to the extent they conflict with this section.

We may update these Terms from time to time. Material changes will be flagged at the top of the document with a new effective date, and we'll send you notice through the app or by email at least 14 days before they take effect. If you keep using HeyArab after the change date, you accept the updated Terms. If you don’t agree with a change, you can delete your account before the change takes effect.

• These Terms (together with the Privacy Policy and any in-product notices we ask you to accept) make up the entire agreement between you and HeyArab about the service.
• If a court finds part of these Terms unenforceable, the rest remains in force.
• Our failure to enforce any part of these Terms isn’t a waiver of our right to enforce it later.
• You can’t assign these Terms to anyone else without our written consent. We can assign them to an affiliate or to a successor in connection with a corporate transaction.
